MakerBot Children’s Privacy Policy

I. Introduction and Purpose.

The Children’s Online Privacy Protection Act of 1998 and its rules (collectively, “COPPA“) require us to inform parents and legal guardians (as used in this policy “Parents“) about our practices for collecting, using, and disclosing personal information from children under the age of 13 (“Child” or “Children“). It also requires us to obtain verifiable consent from Parents if there is any collection, use, or disclosure of a Child’s personal information.

MakerBot uses certain technologies, such as persistent identifiers and cookies, to automatically collect information from Users when they use our Sites and Services. This MakerBot Children’s privacy policy (“MakerBot Children’s Privacy Policy”) notifies Parents of:

  • Our practices concerning personal information from Children.

  • How Parents can create an Account on behalf of their Child.

  • How educational users that use our Sites and Services for educational instruction can comply with this MakerBot Children’s Privacy Policy.

This MakerBot Children’s Privacy Policy supplements our main MakerBot Privacy Policy (https://www.makerbot.com/legal/privacy). Terms that are defined in the MakerBot Terms of Use, to which this MakerBot Children’s Privacy Policy is incorporated (https://www.makerbot.com/legal/terms), or terms in the general MakerBot Privacy Policy (https://www.makerbot.com/legal/privacy) have the same meanings as used in this MakerBot Children’s Privacy Policy.

II. Children Using the Sites and Services.

Children may not register an Account for use of the Sites nor may use the Services. Children may only register an Account for use the Sites and Services if MakerBot has received verifiable consent from the Parent of a Child seeking to create an Account. If a Child accesses our Sites or Services via a third party integration into our Sites and Services, the Child still may not register an Account for use of the Sites nor may use the Services.

III. Parents Registering On Behalf of Children.

Parents may create an Account for use of the Sites and Services on behalf of their Child only if all of the following is true:

  • (a) The Parent creating the Account is the Child’s legal guardian; and
  • (b) The Parent uses his or her own personal information only, and not any personal information of the Child, to create the Account.

MakerBot has the right to seek direct or third-party verification of any Account created on behalf of a Child and reserves the right to take legal action against any user of the Sites and Services who creates an Account on behalf of a Child without the proper authorization required under this MakerBot Children’s Privacy Policy and/or COPPA.

IV. Educational Organizations Using the Sites and Services.

We have created certain products that allow educators to provide Children educational instruction using the Sites and Services.

If you are an educator using our Sites and Services to provide education instruction to Children (each a “Child Educator”), you may create an Account for use of the Sites and Services on behalf of your students only if all of the following is true:

  • (a) The Child Educator uses his or her own personal information only, and not any personal information of the Child, to create the Account; and
  • (b) The Child Educator uses the email account associated with his or her education institution to create the Account.
